RULES AND REGULATIONS REGARDING THE USE OF THE FESTIVAL WRISTBAND AS A PAYMENT INSTRUMENT

ART 1. GENERAL PROVISIONS
The purpose of these Terms and Conditions (hereinafter TCG) is to establish the general terms of use of the FESTIVAL WRISTBAND (hereinafter referred to as the wristband, Summer Well wristband or Festipay wristband) for the event called the Summer Well Festival, which will take place between 11 -13 August 2023 in Buftea, on Stirbey Domain.
The Organizer of the Event is Livada Advertising SRL (Aleea Bujorului Street 1, Bl D9, Sc. A, Ap 1, District 6, Bucharest, Postal Code 61927, hereinafter referred to as Livada Advertising). Registered at the Trade register with no. J40/7643/2003, Sole Registration Number RO15495420, bank account RO46RZBR0000060003301154, Raiffeisen Bank, Dorobanti Agency

This Regulation also contains the rights and obligations of the Organiser, Livada Advertising, its agent, Spectacular Production and of the natural persons who use the Summer Well bracelet (hereinafter referred to as participant or holder of the bracelet) regarding the use of the Summer Well bracelet.
By taking over the wristband, the vistor agrees with the provisions of this TCG and accepts to be bound thereby. Festipay wristband is an electronic voucher issued by Livada Advertising through its representative Spectacular Production, which will be used as a payment method, exclusively or non-exclusively, at the event organized by Livada Advertising. The wristband is an RFID wristband based on touchless technology. The wristband cannot be considered a bank card or a cash equivalent.
The wristband may be used for payment in 2023 at Summer Well Festival, during the term of this event, at the commercial facilities operating at the event site provided by Livada Advertising.
Expiration date of the wristband: August 14, 2023, 04:00 a.m.
The balance remaining on the wristband can be withdrawn until the final time of withdrawal defined in article 8. The terms of withdrawal are also set forth in article 8. The wristband contains no information about the wristband holders. The wristband is valid from takeover, it can be used following its recharge. The wristband can be taken over against a deposit of 0 lei. The balance of the wristband, as recharged at Summer Well Festival, cannot be used at a subsequent event.
ART.2. WRISTBAND REQUEST, REGISTRATION
The visitors will receive a wristband when their ticket is scanned. On the back of the wristband there is going to be a PIN code, along with the bracelet number. This code must be kept and used to register the wristband on summerwell.ro/topup
In order to top-up online, the user must create an account on summerwell.ro/topup and has 2 options: to create an account by logging in with Facebook or using the email address.
The user can then add the wristband to his account or using the assigned PIN number and the wristband number that is on the mini-card attached to the wristband.
Users can register their wristband on summerwell.ro/topup until August 20, 2023, 23:59.
An account can host multiple wristbands if the user has the wristband number and PIN assigned. The amount on all wristbands can be refunded on a single account (an IBAN).
Cancellation or replacement of the lost or damaged wristband can only be requested by registered participants.
The wristband can be used without registration, but the registration increases the safety of the wristband use, as only after registration can the visitor cancel a lost wristband.
We would like to warn all wristband holders that without registration the electronic voucher embodied by the lost wristband, cannot be used by the original owner of the wristband thereafter (and anyone, who finds the wristband can use up the balance, as the wristband cannot be cancelled).
With regard to this, registration is highly advised. As the name of the holder is not indicated on the wristband, the visitor is advised not to give it to others, and to keep it at a safe place. The Organiser takes no responsibility for damages caused by non-compliance with the abovementioned, loss or damage of the wristband, use by unauthorized persons, and the absence of registration. Liability for the abovementioned is expressly excluded.
ART.3. RECHARGING BALANCE, REPLACEMENT OF WRISTBAND
The wristband can be recharged cash or by card.
The wristband can be charged online, on summerwell.ro/topup, or at the event (offline) at the Credit Points within the festival.
For each load the minimum amount is 10 lei. The maximum balance of the wristband is 9000 lei and the maximum amount of a single load is 4000 lei. The wristband can be used to pay any amount, if the balance allows it.
The wristband can be loaded only in lei.
Complaints can only be made to Credit Points after loading, e.g. the transaction, if the difference can be clearly determined, etc. Complaints are not accepted after leaving the Credit Point.
The replacement of a lost wristband can be requested in person at the information point, following the cancellation of the wristband The balance of the canceled wristband will be transferred to the new wristband within 30 minutes (See also: wristband replacement / cancellation rules in Articles 6 and 7 of this TCG).
The user can check the history of transactions made in the Transaction History section on summerwell.ro/topup
The charging / recharging points (Credit points) of the festival wristband will be opened according to the following schedule:
Friday, August 11: 14:00 - 02:00 a.m
Saturday August 12 12:00 - 02:00 a.m
Sunday, August 13, : 12:00 - 02:00 a.m.
ACTIVATION OF THE BALANCE SUBMITTED ONLINE
- It is made at any point of sale within the festival by the staff, by pressing the 7 key and approaching the terminal wristband.
- The amount must be activated in order to be used. Inactivated transactions can be seen with the status "PENDING" in the user's account - Transaction History section on summerwell.ro/topup.
Art. 4. PAYMENT WITH WRISTBAND
Payment is made at the vendors with the use of payment terminals. The terminal has two parts:
(i) a reader with a display, which is placed on the counter, and is well visible to the wristband holder; and
(ii) a POS terminal, which is placed on the counter for the shop assistant, and is not necessarily visible to the visitor.
The process of payment:
(i) the shop assistant enters the final amount of the purchase into the cash register, and into the POS terminal;
(ii) after the purchase amount is given it is shown on the display of the reader, and if the visitor accepts the indicated amount, he/she puts the wristband to the reader, with which the transaction takes place;
(iii) the balance of the voucher is decreased with the amount;
(iv) the display of the reader shows the new balance.
If the transaction was made in error with an incorrect amount or if it has to be canceled for any reason, it can be made at the payment terminal. Cancellation of a transaction is possible only at the terminal where the transaction was made and only if this was the last transaction made both in terms of the terminal and on the wristband. Otherwise, it is not possible to cancel the transaction. Cancellations can also be made through the system, in which case an amount greater than the actual amount of the purchase is entered. In this case, visitors are specifically advised to check the amount entered. The voucher is given by the seller. If the purchased product is taken over by the visitor, the terms regarding the return of the product are established by the seller and the buyer in accordance with the relevant laws in force.
ART.5. CHECKING THE BALANCE
The balance of the voucher wristband can be checked at the vendors accepting the wristband, at the top up points or online on www.summerwell.ro. The visitor shall accept the database and the statement of Livada concerning the balance of the wristbands as final and applicable.
ART.6. REPLACEMENT OF THE WRISTBAND
If the wristband is lost or damaged in any way, you may request a new one. The cost of replacing the wristband is 0 lei. If the participant has not registered, the old wristband cannot be canceled. The balance of the old wristband - minus the amount of the deposit and transfer fee - can only be transferred to the new wristband, if the old wristband has been registered and previously canceled. The balance is transferred to the Credit points. At the time of the balance transfer, the person requesting the transfer identifies himself with an identity document (identity card, passport, wristband ID) and accepts that his personal data (name, address, ID card number or passport and phone number) be registered.
The data recorded in this way will not be processed, but will be used only in accordance with the provisions of Law CXII of 2011 on self-determination of information and freedom of information and other relevant laws.
If the provision of data is refused, the assistant nurse's assistant is not obliged to carry out the transaction. In case of transfer, the visitor is informed about the transfer procedure and agrees that it will be carried out in accordance with the above terms. In case of a damaged wristband, it is necessary to present and cancel the old wristband for the purchase of the new wristband. A new wristband can be requested at the top points from the assistants.
ART.7. CANCELLATION OF THE WRISTBAND
The balance of a lost, damaged, or stolen wristband can only be cancelled if it has been previously registered.
The visitor can cancel their wristband at the recharging points. If the participant so requests, the balance of the canceled wristband will be transferred to the new wristband within 30 minutes of the cancellation.
ART.8. WITHDRAWAL OF THE BALANCE
The unused amount can be withdrawn at the Credit points by the participants who registered the wristband on summerwell.ro/topup or offline (at the Credit points at the festival), rounded to the nearest 1 leu. The participant is also given a withdrawal voucher.
The owner of the wristband can withdraw the unused balance at any time when the festival is open. Withdrawal may be requested by the wristband holder at the charging / recharging points. In case of withdrawal of a larger amount, the assistant is entitled to verify the identity of the wristband holder and to request withdrawal from the Financial Center. The visitor understands that he should wait because of this procedure and the time required for approval. The last time the balance can be withdrawn at Summer Well is August 14, 2023, at 02:00, after which the withdrawal can be made only on summerwell.ro/topup by the participants who uploaded / reloaded online and entered the PIN code of the wristband. Withdrawal of the balance can be requested on summerwell.ro/topup only until August 20th, 2023, 23:59.
Visitors are asked to be careful not to let the balance withdraw at the last minute.
The unused amount can be withdrawn online by the participants who uploaded the wristband online (in the Summer Well mobile application), rounded to the nearest 1 leu.
The unused amount can also be withdrawn online by the participants who uploaded the wristband offline. To do this, the wristband must be registered online by August 20th at 23:59.
At Credit Points it is only possible to return the money from the wristbands uploaded offline and online.
The unused amount can be withdrawn online only if the participant keeps and adds the PIN code on summerwell.ro/topup. The PIN code can be found on the back of the wristband that is placed on his hand. To request the withdrawal of the unused amount, you must enter your name, first name and IBAN correctly. Users must be careful about the details they enter, we are not responsible for incorrect data entry.
In order to withdraw the unused amount online, the participants must submit the withdrawal request on summerwell.ro/topup starting from 16.08.2023 at 10:00 until 20.08.2023, at 23:59. The deadline for returning the requested amount is September 30, 2023.
The minimum amount available for refund on summerwell.ro/topup is 20 lei.
The amounts between 1 leu and 20 lei can be withdrawn only from the Credit Points at the Festival.
For the amounts in lei, it’s free of any bank commission.
For any amount in foreign currency there will be a bank commission of 15 EUR regardless the amount.
ART.9. DATA PROCESSING
The visitor acknowledges and agrees that his/her personal data be used by Festipay Zrt. (1135 Budapest, Reitter Ferenc u 46-48., Reg. no.: 01-10-048644, tax no.: 25405983-2-41), which operates the voucher system, in connection with the use of the voucher, in accordance with the provisions of Act CXII of 2011 on information self-determination and freedom of information, and other laws in effect concerning data protection. The data shall be stored following the event in compliance with the relevant laws, and then shall be deleted.
The data used cannot be linked to an individual, except in the case of registration, when the visitor voluntarily consents to the use of the data. In case of registration the data shall be linked to his wristband code.
The primary purpose of the use of the data is the registration of the voucher wristbands.
The visitor (with simultaneous inactivation of his/her wristband) may request the deletion of his/her personal data (i.e. withdraw the consent to the use of his/her personal data). The deletion can be requested from Festipay Zrt. by mail or e-mail. The visitor may – wholly or partially – withdraw his/her consent given earlier, without being required to state the reasons thereof, Festipay Zrt. following the receipt of the notification concerning the withdrawal, and the inactivation of the wristband shall forthwith provide for the termination of the data use, and shall irrevocably delete the visitor from its registry, and delete the personal data concerning the withdrawal, of which it notifies the requester.
ART.10. COMPLAINTS, LAPSE
Complaints can only be made if the wristband is also presented.
With the visitor accepting the present document, Livada Advertising and the visitor agree that any claims arising out of the legal relationship specified herein may only be enforced within a lapse period of 6 months.
No photo or video or any other visual recording shall be made of the top up points (either from the outside or the inside), or of the employees there. For such recordings the prior written consent of Festipay Zrt. is required. The above rules shall apply to all audio- or visual recordings of the employees at the recharging points too.
Livada is entitled to unilaterally modify this GTC, on the understanding that it shall simultaneously notify the visitors thereof.
